In a recent case, a trial judge took custody of a two-year-old away from her mother because the Mother worked nights and had to sleep during the day when the child was awake. The Grandmother of the child cares for the child while the Mother is at work and catches up on sleep during the day. Upon review, the Court of Appeals reversed, finding that there was a failure to show that the night work schedule had an adverse impact on the child. VOSS v.
